E2 Business Visa What is E2 Business Visa? E2 Visa is an investors visa that allows you and your family (spouse and children under age 21 ) to live in the United States for at least 2 (unlimited extensions) years or more as long as you invest and maintain your investment. It is much cheaper than EB5 Immigrant Investor Green Card Scheme. There is no set minimum level of investment which may qualify for E2 Visa Treaty Investor status. Our recommendation is at least $50,000 if in the United States and $100,000 if outside. There is currently no quota or annual cap, so E2 visas are unlimited in the number available. The business should create employment in the US for both the E2 treaty visa national investor and US citizens and residents. The investment must be in an active and operating business that requires people to work in the business. Therefore passive investments in say property or stocks and bonds do not qualify. An E2 visa basically allows you to buy entry into the USA without actually "immigrating." The E2 can be renewed indefinitely as long as the investor is running the business and it generates "more than enough revenue" to support the investor's family. You can invest in virtually anything or trade in virtually anything. Investors must place their funds in the hands of a bank or closing agent who is instructedto release the funds to the seller of the property or business upon visa approval. E2 visas are considered nonimmigrant visas. However, once an investor is able to qualify and enter into the U.S. in this category, they are able to look for other opportunities and to apply for green cards and eventually citizenship. E2 visa holders may only work for themselves or the E visa enterprise. Spouse gets a work permit and can freely work for any other company. E2 visa holders and dependents may study in the US. E2 visa holders do not have to live in the US any particular amount of time and may arrange their affairs so they are not subject to world wide taxation. SINP Entrepreneur The Nomination Process The Entrepreneur Category of the Saskatchewan Immigrant Nominee Programme (SINP) gives applicants the chance to start, buy, or co-own a firm in Saskatchewan and take an active role in its operations. In an online survey, potential immigrants express their interest in living in Saskatchewan and running a business there by answering questions about their entrepreneurial background, assets, and Business Establishment Plan (BEP), among other things. Candidates that satisfy the minimal requirements for entry will be added to the EOI applicant pool, where they will receive a score and be ranked based on selection criteria on a points criteria grid. Step 2: Call for Applications On the basis of their score, candidates are chosen from the EOI system. Prioritisation for selection and official application submission goes to the highest scoring EOIs. Candidates who have been chosen are encouraged to apply to the SINP under the subcategory of Entrepreneur immigration. After that, candidates go through the verification procedure. A SINP Entrepreneur Approval Letter, proving support for the applicant's request to the IRCC for a two-year temporary work permit, will be given to those who successfully complete this stage. With this permission, the candidate can lawfully live and work in Saskatchewan while carrying out the business proposal. Step Three: Nomination An applicant may apply to have the SINP nominate them for permanent residence after they have fulfilled the requirements of the Business Performance Agreement. Dual Intent means that you come as a non-immigrant and then can apply for immigration if you are successful as an executive in the USA. After the first year you can apply for a Legal Permanent Residence (EB1C Green Card) If you have DO NOT HAVE US Office for your company If a foreign company does not yet have a U.S. office you can send an owner, executive or manager to the United States with the purpose of opening a new office. The Employer must be a branch office of the foreign company The Employee must: Generally have been working for a qualifying organisation abroad for one continuous year within the three years immediately preceding his or her admission to the United States; and Be seeking to enter the United States to provide service in an executive or managerial capacity for a branch of the same employer. Executive capacity generally refers to the employee’s ability to make decisions of wide latitude without much oversight. Establishing a New Office For foreign employers seeking to send an employee to the United States as an executive or manager to establish a new office, the employer must also show that: The employer has secured sufficient physical premises to house the new office; The employee has been employed as an executive or manager for one continuous year in the three years preceding the filing of the petition; and The intended U.S. office will support an executive or managerial position within one year of the approval of the petition. We recommend creating at least 5-7 US based jobs. Period of Stay Qualified employees entering the United States to establish a new office will be allowed a maximum initial stay of one year.
